HannaH - Terms of Service

Welcome to HannaH ("the App," "we," "us," "our"), a baby tracker, pregnancy tracker, period tracker, and parenting companion application operated by MV Studio ("Company"). These Terms of Service ("Terms") govern your access to and use of the HannaH mobile application, available on iOS and Android.

By downloading, installing, or using HannaH, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account or using HannaH, you confirm that:

You have read, understood, and agree to these Terms and our Privacy Policy.
You are at least 13 years of age (or the minimum age of digital consent in your jurisdiction).
If you are between 13 and 18 (or the age of majority in your jurisdiction), you have parental or guardian consent to use the App.
You have the legal capacity to enter into a binding agreement.

2. Eligibility

HannaH is designed for parents, expectant parents, guardians, and adults planning a family.
You must be at least 13 years old to create an account. Users under 18 must have parental consent.
The App is not intended for use by children. All child-related features (baby tracking, child profiles) are intended to be operated by a parent or guardian on behalf of their child.

3. Account

3.1 Account Creation

You may create an account using Google Sign-In, Apple Sign-In, or email/password. You are responsible for:

Maintaining the confidentiality of your account credentials.
All activities that occur under your account.
Providing accurate and current account information.
Notifying us immediately of any unauthorized use of your account.

3.2 Account Deletion

You may delete your account at any time through Settings > Delete Account within the App, or by emailing hannah@mv-studio.net. Account deletion permanently removes all your data as described in our Privacy Policy. This action cannot be undone.

4. Description of Service

HannaH provides the following features:

Period & Cycle Tracking: Log menstrual cycles, predict periods, track symptoms and fertility windows.
Fertility & TTC: Ovulation tracking, fertile window estimation, conception planning tools.
Pregnancy Tracking: Week-by-week pregnancy information, kick counter, contraction timer, hospital bag checklist, pregnancy notes, and appointments.
Baby Tracking: Feeding (breast, bottle, solids), sleep, diaper changes, growth measurements, milestones, and developmental achievements.
AI Lullaby Generator: Personalized AI-generated songs for your child.
Bedtime Stories: AI-generated and curated bedtime stories.
AI Companion: AI-powered parenting support chat.
Guided Meditations: Relaxation and wellness content for parents.
Product Safety Scanner: Barcode scanning with ingredient analysis and allergen detection.
Photo Memories: Photo storage and milestone documentation.
Parent Wellness: Mood tracking, gratitude journal, self-care tools.

5. Subscriptions and Payments

5.1 Free Tier

HannaH offers a free tier with the following limitations:

Up to 30 tracking events per day
Up to 50 photos
1 child profile
Advertisements displayed
Limited access to premium features

5.2 Premium Subscription

HannaH Premium removes all limitations and ads, and provides full access to all features. Premium is available in three plans:

5.3 Lifetime Subscription Definition

"Lifetime" means the lifetime of the product, not the lifetime of the user. A Lifetime subscription grants you access to HannaH Premium features for as long as the HannaH app continues to be available and maintained by MV Studio. In the event that MV Studio decides to discontinue the HannaH app or substantially change the nature of the service, we will provide at least six (6) months' advance notice to Lifetime subscribers via email and/or in-app notification before any such discontinuation takes effect. During this notice period, all Lifetime Premium features will remain fully functional.

5.4 Billing and Cancellation

All payments are processed through Apple App Store (iOS) or Google Play Store (Android).
Prices are displayed in your local currency and may include applicable taxes.
Monthly and Yearly subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
You can manage and cancel your subscription through your device's subscription settings (iOS: Settings > Apple ID > Subscriptions; Android: Play Store > Subscriptions).
Refunds are handled by Apple or Google according to their respective refund policies. MV Studio does not process refunds directly.
No refunds are provided for partial subscription periods or for the Lifetime plan after purchase.

5.5 Song Bundles

In addition to subscriptions, HannaH offers one-time song bundle purchases for AI-generated lullabies. These are non-refundable consumable purchases processed through Apple App Store or Google Play Store.

6. User Content

6.1 Your Content

You retain full ownership of all content you create or upload to HannaH, including:

Photos and images
Custom milestones and notes
Tracking data and health information
Chat messages
Gratitude journal entries
Pregnancy notes

By using the App, you grant MV Studio a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the App's services to you. We do not use your content for advertising, marketing, or AI model training.

6.2 AI-Generated Content

Content generated by AI features (songs, stories, chat responses) is provided for your personal, non-commercial use. You may share AI-generated songs and stories with family and friends for personal enjoyment. MV Studio and its AI service providers retain no ownership claims over personalized AI-generated content created specifically for you.

6.3 Prohibited Content

You agree not to upload or transmit content that:

Is illegal, harmful, threatening, abusive, or harassing.
Violates the rights of others, including intellectual property rights.
Contains malware, viruses, or other harmful code.
Attempts to exploit or harm minors in any way.
Impersonates any person or entity.

7. AI-Generated Content Disclaimer

AI features in HannaH are for entertainment and informational purposes only.

AI Songs & Stories: AI-generated lullabies and bedtime stories are created for entertainment. They are not reviewed by medical or child development professionals. Song lyrics and story content are generated by artificial intelligence and may occasionally contain unexpected or imperfect content.
AI Companion Chat: The AI companion provides general parenting information and emotional support. It is NOT a substitute for professional medical advice, mental health counseling, or emergency services. If you are experiencing a medical or mental health emergency, contact your local emergency services immediately.
Accuracy: AI-generated content may contain inaccuracies. Do not rely on AI responses for medical, legal, or safety-critical decisions.

8. Product Scanner Disclaimer

The product safety scanner is for informational and educational purposes only.

Product information and ingredient data is sourced from public databases (Open Food Facts, Open Beauty Facts, UPCitemdb, Go-UPC) and AI-powered web searches. We do not guarantee the accuracy, completeness, or timeliness of this information.
Allergen detection is based on database analysis and may not identify all allergens in a product. Product formulations may change without notice.
Safety scores and ingredient ratings are informational opinions, not medical or scientific certifications.
Always read the actual product label, especially for severe allergies or when feeding infants and young children.
The product scanner does NOT constitute medical advice. Consult healthcare professionals for allergy testing, dietary guidance, and medical decisions.
MV Studio assumes no liability for any harm arising from reliance on product scanner results.

9. Health Data Disclaimer

HannaH is NOT a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

Period & Fertility Tracking: Cycle predictions, fertile window estimates, and ovulation predictions are statistical approximations based on your logged data. They should NOT be used as a primary method of contraception or fertility treatment. Consult a healthcare provider for family planning.
Pregnancy Tracking: Week-by-week information is general educational content. Kick counters and contraction timers are personal logging tools, not medical monitoring devices. Always follow your healthcare provider's guidance during pregnancy.
Baby Growth & Development: Growth charts and milestone information are general references. Every child develops differently. Consult your pediatrician for developmental assessments.
HealthKit Integration: Health data synchronized via Apple HealthKit is for your personal convenience. It does not constitute clinical health monitoring.
Emergency Situations: If you or your child are experiencing a medical emergency, call your local emergency services immediately. Do not rely on the App for emergency guidance.

10. Children's Privacy (COPPA)

HannaH is designed for parents and guardians to track and manage information about their children. The App is NOT intended for direct use by children under 13.
Parents/guardians are solely responsible for the data they enter about their children.
We do not knowingly collect personal information directly from children under 13 (or under 16 in the EU).
Child profile data is stored within the parent's authenticated account and protected by the same security measures as all user data.
Photos of children are stored in the parent's private cloud storage and are never shared, used for advertising, or used for AI training.
If you believe a child has provided personal information directly to us, please contact hannah@mv-studio.net and we will delete such information promptly.

11. Intellectual Property

The HannaH app, including its design, code, features, branding, logos, and non-user-generated content, is the intellectual property of MV Studio.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
You may not copy, modify, distribute, sell, or lease any part of the App or its content, nor may you reverse-engineer or attempt to extract the source code.
Bundled content (meditations, educational articles, default stories) is licensed to MV Studio and may not be redistributed.

12. Prohibited Uses

You agree not to:

Use the App for any unlawful purpose or in violation of any applicable laws.
Attempt to gain unauthorized access to the App's systems or other users' accounts.
Interfere with or disrupt the App or its servers.
Use automated means (bots, scrapers) to access the App.
Use the App to distribute spam, malware, or other harmful content.
Misrepresent your identity or impersonate another person.
Share your account credentials with others.
Use the App's health features as a substitute for professional medical care.
Circumvent or attempt to circumvent subscription restrictions or free tier limitations.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
MV STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, HEALTH OUTCOMES, OR RELIANCE ON APP INFORMATION.
MV STUDIO'S TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
NOTHING IN THESE TERMS LIMITS LIABILITY FOR DEATH, PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR ANY LIABILITY THAT CANNOT BE EXCLUDED BY LAW.

14. Indemnification

You agree to indemnify, defend, and hold harmless MV Studio, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

Your use of the App.
Your violation of these Terms.
Your violation of any third-party rights.
Content you upload or transmit through the App.

15. Termination

You may terminate your use of the App at any time by deleting your account and uninstalling the App.
We may suspend or terminate your account if you violate these Terms, engage in prohibited uses, or if required by law.
Upon termination, your right to use the App ceases immediately. Data deletion follows the procedures described in our Privacy Policy.
Sections 6 (User Content ownership), 7-9 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnification), and 18 (Governing Law) survive termination.

16. Service Availability

We strive to maintain the App's availability but do not guarantee uninterrupted access.
The App may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with reasonable notice for material changes.
Core tracking features are designed to work offline using local on-device storage, ensuring basic functionality even without internet connectivity.

17. Changes to Terms

We may update these Terms from time to time. When we make material changes:

We will update the "Last updated" date at the top of this page.
We will notify you via an in-app notification or email (for material changes).
Continued use of the App after changes constitutes acceptance of the updated Terms.
If you disagree with the updated Terms, you must stop using the App and delete your account.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Croatia, without regard to conflict of law principles.

Any disputes arising from these Terms or the use of the App shall first be attempted to be resolved through good-faith negotiation.
If negotiation fails, disputes shall be submitted to the competent courts of the Republic of Croatia.
For EU/EEA residents: This does not affect your statutory rights under EU consumer protection law, including the right to bring proceedings in your country of residence.
For EU consumers: You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MV Studio regarding the use of HannaH. They supersede any prior agreements, communications, or understandings, whether written or oral.
